The deadline for entries has passed and we are working on bringing you all 97 entries (you read that right, there are 97 entries!)... the voting page will be online sometime on Monday 24th May!
THE PRIZE
The winning remix, as chosen by Andy Bell and Mute Records, will be included
on a forthcoming Andy Bell commercial release. That winner and the creators
of the other five shortlisted remixes will also each receive framed lyrics
to 'Say What You Want' handwritten by Andy alongside a personal
message from him.
HOW IT WORKS
All the remixes submitted to the competition will be streamed on this
website and the six favourites - as voted for by visitors to the site
- will be presented to Andy who, with Mute Records, will choose the winning
remix which will be given the ultimate accolade of appearing on a future
official Andy Bell release.
HOW TO ENTER
To enter all you need to do is to download
all the necessary elements and then reassemble them in a new and exciting
way (all genres of music are welcome). Once your remix is complete (the
file size must not exceed 10MB by the way) you will need to upload
it for us so that we can stream it on the voting page.
THE TIMEFRAME
All entries will need to be uploaded by 5pm (UK) on May 21st 2010. Voting
by visitors to this website will begin on May 24th 2010 and will continue
until June 4th 2010 at which point the six remixes with the most votes
will be sent to Andy and Mute Records who will choose the overall winner.
TERMS AND CONDITIONS
You (the Entrant) hereby agree, confirm, represent and
warrant that:
1. All rights in and to any remixed versions ('Remixes') of the song 'Say What You Want' ('the Song') created by the Entrant shall be owned by Mute Records Ltd and to the extent necessary the Entrant hereby assigns all rights in the Remixes of the Song to Mute Records Ltd throughout the World for the full life of copyright and any and all extensions and renewals thereof. If requested by Mute Records Ltd, the Entrant shall complete and sign a formal assignment of copyright to give effect to the foregoing;
2. All rights in and to any Remixes of the original sound recording of the Song ('the Master') created by the Entrant shall be owned by Mute Records Ltd and to the extent necessary the Entrant hereby assigns all rights in the Remixes of the Master to Mute Records Ltd throughout the World for the full life of copyright and any and all extensions and renewals there. If requested by Mute Records Ltd, the Entrant shall complete and sign a formal assignment of copyright to give effect to the foregoing;
3. Andy Bell and Pascal Gabriel will be registered and credited as the sole writers and Minotaur Music Ltd/Sony Music Publishing and Gabriel & Son Ltd./Kobalt Music the publishers of the Remixes of the Song created by the Entrant;
4. the Entrant will not acquire a copyright interest in the Song by virtue of creating Remixes of the Song;
5. the Entrant will not use any other elements or parts of the Song ('Stems') otherwise than to create Remixes of the Song for entry into the AndyBell.com 'Say What You Want' remix competition;
6. the Remixes of the Song do not incorporate any samples or other materials which are subject to third party proprietary rights (for the avoidance of doubt this includes but is not limited to, other Andy Bell sound recordings) or otherwise infringe the rights of any third party;
7. the Remixes of the Song are not obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or encouraging of conduct that would be considered a criminal offense, gives rise to civil liability, or violate any law;
8. the Entrant will not exploit, or allow others to exploit, the Remixes of the Song created by the Entrant without seeking the prior approval of Mute Records Ltd.
9. by submitting Remixes through AndyBell.com, the Entrant agrees to release and hold harmless Mute Records Ltd from and against any claim or cause of action arising out of such Remixes or Entrant’s participation in the promotion.
10. the Entrant irrevocably waives throughout the world any and all rights of paternity and moral rights in and to the Remixes of the Song and agrees not to make any claims against Mute Records Ltd or any party authorised by Mute Records to commercially exploit the remix.
11. Mute Records Ltd is not liable in any way for any costs, expenses, damages, liability or injury arising out of or in any way connected with the creation or exploitation of the remix.
12. In submitting Remixes to the competition the Entrant confirms and warrants that they have full power and authority to enter into this agreement and hereby indemnify Mute Records Ltd from and against any and all costs and damages incurred as a result of any breach of the representations and warranties made by the Entrant herein.
13. AndyBell.com and Mute Records Ltd reserves the right, in its absolute discretion, to remove Remixes from the website that it deems offensive or inappropriate and/or Remixes that breach any of the above terms and conditions.
14. these terms shall be governed and construed in accordance with English Law.
